GENERAL TERMS AND CONDITIONS FOR APPLICATION WEBSITE
§ 1 General clauses, scope of application
The following General Terms and Conditions (GTC) regulate the contractual relationship between Akademie Schloss Solitude, Solitude 3, 70197 Stuttgart (hereinafter known as “Akademie”), and consumers (hereinafter known as “Ordering Parties”) who use the range of information placed at their disposal by the Akademie for downloading purposes, consisting of application forms for fellowships in PDF form. These GTC regard the related use of the website http://bewerbung.akademie-solitude.de/ and the accompanying sub-domains. The current version of the GTC valid at the point of the contract’s conclusion shall prove binding. Consumers in the sense of the present General Terms and Conditions are natural persons who enter into a commercial relationship with the Akademie in order to acquire the aforementioned application forms, without this being ascribed to their existing commercial or independent activities.
§ 2 Contractual object, contractual conclusion and supply
The Akademie’s online range of information-related products constitutes a non-binding invitation to the Ordering Party to order application forms for fellowships from the Akademie. By ordering the desired form online, the Ordering Party thereby submits a binding offer regarding the conclusion of a purchase contract. The Akademie shall immediately confirm receipt of the Buyer’s order by email, subsequently making the application form available to download in PDF form; in other cases, the offer shall be deemed rejected. Any additional dispatch of the forms in the wake of the contract’s conclusion shall only take place by prior arrangement. The Akademie’s performance and supply obligations shall be fulfilled with the provision of the forms as downloadable PDF files.
No additional claims, particularly those regarding a legal claim to the awarding of a fellowship, shall exist as a result of the contract’s conclusion.
Any application documents submitted will not be returned. Said application documents will be destroyed in the event that the Ordering Party’s application is rejected. The Akademie shall bear no liability for any original documents submitted.
§ 3 Payment
The Akademie shall accept only those payment methods made available to the Buyer during the ordering process. The Akademie reserves the right to accept or reject specific payment methods in individual cases.
§ 4 Prices
The price stipulated for the object of purchase and stated on the individual offer shall constitute a total price, this including possible VAT and additional price components. The application forms shall only be made available for downloading purposes; the price shall thus not include any supply and mailing expenses.
§ 5 Limitations of liability
The Akademie shall only be liable for damages other than those relating to life-threatening injuries, bodily injuries and health risks in so far as these damages are the result of intentional or grossly negligent actions or the culpable violation of a significant contractual obligation by the Akademie or its vicarious agents. Significant obligations shall be deemed obligations whose fulfillment facilitates the correct implementation of the contract, and upon the observance of which the Buyer may rely. Any compensation-related liability exceeding the above shall be excluded. Claims arising from a possible guarantee issued by the Akademie and relating to the nature of the object of purchase and product liability law shall not be affected by the above.
Even the best available technology is no guarantee that data communication via the internet will be either faultless or accessible at all times. The Akademie therefore assumes no liability for possible technical restrictions regarding the availability of its online offering.
§ 6 Applicable law, place of jurisdiction
All disputes arising from this legal relationship shall be subject to the law of the Federal Republic of Germany, this insofar as the guaranteed protection is not withdrawn via mandatory legal clauses in the state in which the consumer habitually resides. The validity of international UN purchase rights shall be excluded.
§ 7 Salvatory clause
In the event that one or more of the provisions within the present GTC shall be or become invalid, the remaining provisions shall not be affected, unless the omission of individual clauses proves so disadvantageous to a specific contractual party that it can no longer be reasonably expected to adhere to the terms of the contract.
